These Terms of Use govern the use of the application offered by HomeSpa on the website and through its software. Such application and website together are hereinafter referred to as the “Application.”
Please read these Terms of Use and HomeSpa’s privacy policy carefully (the “Privacy Policy”). Your use of the Application HomeSpa constitutes your acceptance of and agreement the Terms of Use and the Privacy Policy and that you are 18 years of age or older. If you disagree to anything in these Terms of Use or in the Privacy Policy, please then do not use the Application.
Our Platform provides the technology through which we provide the Platform Services to facilitate search between Clients seeking Specialist Services and the Specialist who use our Platform. Our services are limited to making the Platform available, effecting search, Reservation, and payment collection agent on behalf of Specialist for the collection of the Specialist payment.
We also provide some ancillary services such as assisting with customer service issues (again in our capacity as agent for the Independent specialists ).
However, as mention above, the contract for the purchase of the Professional Services is between you and the Independent professional. This means that it is the Independent Specialist (not us) who is legally responsible for providing the Professional Service. However, HomeSpa remains responsible in respect of its obligations to you in accordance with Our Terms which shall be legally binding. The Professional Service you receive through us will be subject to the Independent specialist’s terms and conditions. HomeSpa is not a party to the Independent specialist’s Terms and conditions.
We do not provide Specialists Services and we do not employ any of the specialists.
We are not healthcare providers and neither we nor Specialist provide any medical advice or medical treatments.
For quality control purposes, before allowing a Specialist to use our Platform we ask them to provide document evidence of they practice . We also ensure that all Specialists will provide a diploma or certificate before to let them use our network.
However, we do not take responsibility for the Service quality.
We do not contract with Clients for the provision of Specialists Services. By booking Specialist Services through the Platform you are entering into a contract with the relevant Specialist for the provision of those services. Therefore we accept no responsibility or liability of the Specialist’s performance under that contract.
Through the Platform, Clients may book various Specialists Services. To make a Booking you need follow the instructions on the Platform and provide the necessary information. HomeSpa uses efforts to find a Specialist which will be able to provide that service at your requested time. If in the unlikely event HomeSpa Specialist cannot be with you at the specific time you have reserved , we will contact you to find an alternative time.
All Clients shall be required to pay for chosen service (the amount will be indicated on the Platform at the time of booking), when the Booking has been confirmed. HomeSpa charge a Commission from the Specialist for each Booking, the remainder is belongs to the Specialist.
Your privacy is very important to us. All yours personal and other information, we will collect through the Platform, will be collected and processed in accordance with our Privacy Policy which can be viewed at Privacy Policy.
As part of the effective provision of the Platform Services and quality control purposes, we may request Reviews from you about Therapists and you consent that Therapists will provide Reviews about you to us. You must not knowingly provide false, inaccurate or misleading information in respect of Reviews.
Ownership, use and intellectual property rights
This Platform and all intellectual property rights in it ,including any content on our Platform are owned by us. Intellectual property right is rights such as: copyright, trademarks, domain names, design rights, database rights, patents and all other intellectual property rights of any kind, whether or not they are registered or unregistered (anywhere in the world). We reserve all our rights in any intellectual property in connection with these terms and conditions. This means that we remain owners of them and free to use them as we see fit. The use of any trade marks on the Platform is strictly prohibited unless you have our prior written permission.
